The fifth volume of English-language yarbook, dedicated to problems of competition protection and independent sector-specific regulation, contains seven articles out of which two focuse on economic aspects of competition functioning (prof. Anna Fornalczyk in her article analyzes competition protection from a persepctive of strategic recommendations of Philip Kotler, dr. Michał Wolański in his article estimates lossed resulting from monopolies in urban transport). One article (by dr. Marlena Wach) is dedicated to regulation in telecom sector.
Legal articles in competition protection concentrate on following problems: antitrust assesment of informaton exchange in vertical relations (Antoni Bolecki), inspection of the UOKiK President within antitrust proceeding (dr. Maciej Bernatt, Konrad Stolarski) and functioning of the Polish healthcare system from a perspective of State aid law in the context of ECJ case law (Łukasz Grzejdziak).
The volume also contains legislation and case law reviews, among them a presentation of the Polish group exemption in motor vehicle sector and selected Polish judgments in antitrust cases in 2010 and a presentation of legal amendments in energy, telecommunications, rail transport and air transport. The volume also contains comments on: two ECJ’s judgments responding to preliminary rulings of Polish courts (C-522/08 oraz C-99/09), two judgments of the Court of Appeals in Warsaw and a comment on controversil decisions of the UOKiK President issued at a turn of 2010 and 2011 and imposing a fine on two telecom operators for a failure to cooperate with the UOKIK within an antitrust proceeding.
Three books on competition are reviewed in the volume and reports on seminars and conference as well as CARS annual report are also presented.
